The Week of September 26, 2022 in the City of Waxahachie

    They say that Fall is upon us and hopefully we will see some of that this next week! 
 
    I want to take a quick second to mention that even though a lot of the things that I feel y'all need to know about aren't positive ones, please don't hesitate to reach out to the Council from time-to-time just to say 'Thank you' for either serving or a recent decision that was made.  I reached out this past week regarding a decision that was made about Gateway Monument.  They denied the request for WCDC (sales tax) funds and I think they made a good decision in this case.  Even though I think a 'Welcome to Waxahachie' or 'You're now in Waxahachie' sign might be a good thing in the proper location, I agree with some on Council who said the price tag was way too much for what was proposed and the location wasn't the best.  At any rate, I just want to throw that out there that more often than not, Council members only hear from residents when there's something wrong or regarding something negative, so if you get a chance, please drop them a quick email or letter for something positive some time.  Trust me - they'd really appreciate something like that.  Their contact information can be found on the city's website here: https://www.waxahachie.com/government/city_council/index.php

I'm going to preface this with a note because every case on this agenda is for a plat and there is not a public hearing on these items tonight, so if there is something on there that you would like to address the Commission about, please do so during the Public Comments portion of the meeting.  I will point out two cases that I think folks will want to know about, but again, please keep in mind that these are NOT public hearings.  The Commission will hear from staff, sometimes ask questions of staff or the applicant, but that's it.

3 - Public Comments - Persons may address the P&Z Commission on any issues.

5 - Consider a request for a Plat of Levante, located on the west side of Howard Rd., across from 3175 Howard Rd. The applicant is requesting to plat approximately 150 acres into 121 single-family lots and four open space lots.  Staff is recommending approval per the following comment (which I don't always include, but this one is particularly important) - The Applicant revise and update the plat in the future to reflect the right-of-way improvements required by the TIA (Traffic Impact Analysis).

10 - Consider a request for a Plat of Villaggio at Victron Park, located SW of the intersection of Butcher Rd. and US HWY 77.  The applicant requests to plat the subject 16.925 acres of property into 143 residential lots and 19 open space lots, which is a townhome development within the Victron Park PD (Planned Development). All lot size, dimension, setback, and easement requirements have been met in accordance with the Victron Park PD.  Staff recommends Approval, as presented.

4 - Public Comments

5c - Stampede of Speed is coming back again.  The cattle drive is scheduled for October 7th and will involve some street closures. More details in the packet

5d - Event Application for Big Al's Down the Hatch 5 year anniversary event to be held October 8, 2022.  As I understand it, this event was originally planned to be held at Railyard Park, but this new application changes the location and will have a street closure.  There is a letter from the Downtown Merchants saying this is okay, but I still think Railyard Park probably would've been a better spot and more out of the way.  

5f - Mark your calendars!! The 26th Annual Texas Country Reporter (TCR) Festival is almost upon us!  The festival will take place on Saturday, October 29, 2022 with the set-up beginning on Friday, October 28th.  Diamond Rio will be there!!!  Layout and more details in the agenda packet.  

6 - Introduce Honorary Councilmember - This was a cool thing that the Council did pre-COVID where a WISD student was chosen to sit up at the dais and get to watch a Council meeting up close to see how things are done.  It was a great program and I'm glad to see it back!

7 - 9 - Proclamations

10 - Request to appear by Elizabeth Tull, President of the Waxahachie Arts Council to request extending the contract with the city where they receive 25% of the hotel-motel tax revenues.  This is something that the Council does fairly often (I remembered it being every year, but might be wrong on this), although this contract is for 3 years.

*** 11 - Consider proposed Resolution authorizing defeasance and redemption of the City's outstanding obligations and other related matters.  I won't say that I 100% understand this one; however, it does rub me the wrong way that they were 'unable' to lower the tax rate, yet they are using the debt service portion to pay off or refinance old debt....  They raised the debt service rate this year by 4-5 cents...  That could've meant a 58-59 cent tax rate versus the approved 63 cent one... I definitely recommending reaching out to Council to ask them more about this and what they plan to do.

14 - Consider professional engineering services contract for Wastewater Treatment Master Plan update. "This project will evaluate the existing wastewater treatment plant (WWTP) and Lions Park for future expansion of the existing plant. ADDITIONAL SITES will be evaluated, for discussion and consideration of additional future treatment locations, independent of the current plant site..."  This is a very interesting item and just wanted to make sure y'all knew about it.  More details in the packet.

16 & 17 - Convene into executive session for deliberation regarding real property and to reconvene and take any necessary action.

5 - SUB-64-2022: Consider request for a Plat of Cunningham Estates Phase 2 located SW of the intersection of Old Maypearl Road and Cunningham Meadows Road - located in the ETJ or Extra Territorial Jurisdiction of the City of Waxahachie.  The applicant is requesting to plat the subject property into 109 single family residential lots and 3 common area lots.  Adequate public facilities are available via Buena Vista-Bethel SUD and on-site wastewater services.  Staff is recommending approval per the following condition that states "The applicant shall complete the review process of the TIA [Traffic Impact Analysis] with City staff and shall install or meet any and all requirements of the TIA prior to the recordation of this plat."

The Week of September 5, 2022 in the City of Waxahachie - MOST IMPORTANT MEETING OF THE YEAR

 
Hello Friends! 

    I know... I'm the WORST about saying a newsletter is going to be short and then get so passionate and into it, it turns out to be only slightly shorter than "The Odyssey".  This time, unfortunately, WILL be shorter in content due to my current situation.  Most, if not all of y'all, know I have Multiple Sclerosis.  It's been acting up quite a bit more than we'd like and so I'm having a huge dose of steroids.  While I'm able to type some, it's definitely not the speed that I am normally able to and well, to be frank, I feel like crud.  This is day one, so I wanted to be sure to get this out because there are SO MANY REALLY important city things going on this week.  I will apologize upfront because it is NOT up to my personal standards of supplying you with information, but will try to at least point out things that are remarkable or notable when applicable.  That's already more than I planned to write about this, lol, so let's dive in.

4 - Public Comments: Unfortunately, the most important items on the agenda this evening are NOT listed as "public hearing" on the agenda; therefore, citizens must use the public comments portion of the meeting to address the council on any of these issues.  I would highly encourage you to show up, voice your opinions AND send emails.  Also unfortunately, most of our Council are NOT responsive to emails.  Mr. Wright has been the best and Ms. Wallace second.  Beyond them, I PERSONALLY (and hope it's different for y'all) have not received responses from the others, that I can recall.

5g: City Manager's appointment of member to Civil Service Commission

*** 6 - *** Consider confirmation of Assistant Chief Joe Wiser to become Waxahachie's new Police Chief effective October 1, 2022

7 - Request to appear by Nancy Clifford for approval of Texas Veterans Parade - Ellis County to be held November 5, 2022.  I haven't reviewed the details of this request intimately, but my husband was in the Marine Corps and we very much support all of our men and women who defend our country.  It seems that there might be some routing conflicts and that may be the reason she is going to be speaking with Council.  I don't believe I've seen this type of thing before, since my involvement with the city.  More details in the packet.

8 & 9 - SUB-66-2022 Levante is requesting continuance to Sept. 27th P&Z and Oct. 3rd City Council meetings.  There will be no votes/decisions on this case tonight.

14 - Consider proposed ordinance abandoning and vacating certain right-of-way along Flat Street.  - Details in packet.  I only point this out because it is not something you regularly see come before Council.  I have not researched this and because of that, am neutral on this matter.
 
*** 17 - Consider proposed Ordinance approving revised budget figures for FY 21-22 and approving the Budget for FY 22-23:  Y'all know what I think... They need to cut spending.  Where do you cut it from?  Obviously not public safety.  Politicians like to throw that out there as a scare tactic... "You want to cut from the budget?  What are you gonna cut?  Police?  Fire?"  I've always supported our first responders, so to cut them would be a very hard sell for me.  BUT -- Council needs to direct the city manager and finance manager to find places to cut but keep those that are still in line with the Council's priorities (ex. public safety is a priority).  It is NOT the public's job to justify the city's budget.  It is the job of the city staff and/or council to tell the residents why they NEED MILLIONS more in revenue from last year...
 
*** 18 - Consider proposed ordinance RAISING water and wastewater by 4% and to update the Sokoll rate fee of 1.61 per 1,000 gallons.  (No, it's not listed this way on the agenda.)  They raise the water rates every dang year - BUT!!! I THOUGHT that because we had the smart meters, that the entire program was kept on having the SAME RATE for like 5 years... I could be wrong and I can't find the documentation for it, but I definitely have concerns with this one.  I kid you not... when we moved back to Texas from the desert of New Mexico, we were shocked that we paid more for water in Waxahachie than in the desert.... I kid you not.  These changes are to start with the start of the city's fiscal year and that is October 1, 2022.

*** 19 - Consider a motion to ratify (give official approval) the property tax revenue increase:  In the memorandum for this item, they do NOT specify ANY NUMBERS, just that they're required to take a separate vote to ratify the property tax increase reflected in the budget....

*** 20 - Consider proposed ordinance adoption the 63 cent tax rate for FY 22-23:  I believe it was the first gentleman who spoke at the tax rate hearing last week and he was SO GOOD!  He countered their inflation argument and added that in to the numbers and other things as well and he STILL came up with 61 cents instead of their proposed 63 cents... and what did the Council do?  Talk down to the citizens and make it sound like the residents don't know what they are talking about.  I'm sorry but that is just purely disrespectful.  Y'all... there's like 40k of us and 5 (although 1 for sure is against the tax rate) of them.... why in the world do more people not show up at city hall? 
 
I PROMISE YOU... one of the things they really do think is that it's just a couple of "troublemakers" who want lower taxes... Unless MORE PEOPLE SHOW UP IN PERSON, then that chain of logic remains.  It takes us... and I get it... I actually can't go this week either, but those who can... PLEASE... call friends, neighbors.  ANYONE who is interested in the city's portion of their tax bill.  It's NOT WRONG to ask a governmental entity to cut down on their spending when all the residents are having to buckle down due to all the things they city cites THEY need more money for... 

I'll just quote the city here:
"The proposed rate of $0.630000 is above the no-new-revenue-rate of $0.540834 and lower than the voter-approval rate [the max without an election for voters to approve the rate] of $0.630350."   
'nuff said...

*** 25 - Consider proposed Ordinance amending the Waxahachie Code of Ordinances Chapter 32 "Traffic" - Please read into this.  I get very nervous when codes get changed.  It's a big deal and should definitely not be overlooked.  I'll try to review it myself in the next day or two.

Keeping Hope & Recap on the Waxahachie Tax Increase Public Hearing

 

Hello Friends,


    First, let me thank all the folks who spoke at last night’s Council meeting.  Speaking in public can be intimidating and daunting at best and then throw in a controversial topic like politics and it can make even the strongest person a bit weak in the knees.  I still don’t like speaking in public, so I understand.  Nevertheless, those who showed up to the meeting and those who spoke are to be commended for doing what they felt was right. 

    Next, I have been told that several emails were sent to Council members.  I don’t know if they were for the tax rate or against, but I appreciate all who got involved and took the time to at least send an email!  Participation at the local level of government is so very important because that is the governmental level that really impacts our daily lives and yet many don’t know the importance and some who do know, just don’t care.  I want to be sure that those who contacted Council via email  are recognized for their efforts. 

    I also want to extend a huge THANK YOU to Council Member Billie Wallace who made it very clear that she does NOT support the Council taxing citizens at practically the highest amount they can without an election.  It is unfortunate that she was in the minority, but she stood strong and held to her convictions, so thank you for that!!! I’ve been in her shoes before and it’s hard - really hard.  

    I want to make one clarification for those who were wondering about the vote last night. That vote was not actually approving the tax rate, but was to set the date for the tax rate adoption. I do not believe the item will be listed as a public hearing at the adoption meeting; however, you are welcome to address it in the public comments portion in the beginning of the meeting on Tuesday, September 6th, if you wish.

    Now, here’s the part I really wanted to get to…. I was upset, disgusted and flabbergasted at the behavior from some on our Council last night.  Some called Representative Brian Harrison “irresponsible” for sending a letter to taxing entities asking them to adopt the NNR (no-new-revenue rate).  A state-level elected official reached out to local entities and that’s irresponsible?! I was grateful that Representative Harrison had done such a thing!  All too often, we have elected officials, especially at the state and federal level, who don’t really give much time or effort into the local governmental entities, but he did.   Thank you, Representative Harrison!

    Some Council Members were downright disrespectful to those who showed up, in my opinion. We have a hard time getting residents involved and instead of thanking them, the residents were chastised for not coming to ENOUGH meetings!  That is very belittling to residents. 
I will address some comments made by Mayor Pro Tem Wright.  Last night, Mr. Wright  said pretty much everything he had already said to me in an email on Saturday. I also responded to his email, but none of THAT was mentioned at all, nor did he ever respond to that email or address any of the questions in it.  I will just share my email back to him, which I think covers the question of whether the cities I mentioned are comparable:

“Good Morning Mr. Wright,
My examples were simply to show that cities CAN thrive and adopt the NNR (or below) at the same time.  My basis for comparison was simply North Texas because I knew if I used cities from elsewhere in the state, then THOSE would be called incomparable. 

Waxahachie needs only to compare to Waxahachie. 

1) Is the city giving the taxpayers a break yet or is the city taxing at the max it can without an election?  

2) Why would you or anyone else up at that dais be okay with passing a tax rate that is so far above the NNR that ALSO includes using increments to make the voter approval rate higher so the city can tax even more?

3) Everyone in Waxahachie has had to tighten their belts due to the rising costs of goods and services.  How can you support a total tax levy INCREASE of 23.68% from last year if the 63 cent rate is adopted?  (Numbers from public notice.)

4) “This year’s budget will raise more total property taxes than last year’s budget by $5,647,240 or 19.6%, and of that amount, $2,022,980 is tax revenue to be raised from new property added to the tax roll this year.”  

4A. Did your home budget increase by 19.6%? Ours didn’t and I bet the majority of Waxahachie is like us. 

4B. Why does the city have the right to increase their budget by 19.6%? 

4C. Why can’t the city grow the budget by the $2 Million from new properties? I think that would be a VERY reasonable request. 

5) Why does Waxahachie REFUSE to even explore the possibility of lowering taxes?  THAT is what makes the Council look so bad in the eyes of residents because it looks like y’all don’t care or aren’t even trying to help. 

The honest truth is this:  Waxahachie is literally taxing people (and businesses) at the maximum it can get away with. Yes, you could TRY for higher, but everyone knows that it wouldn’t pass in an election because people are tapped out.  To add insult to injury, those increments were used to bump it up even higher… I just find that reprehensible, to say the least. 

Please consider directing staff to at LEAST split the difference between the NNR and what’s proposed.

    I, like many last night, felt hopeless after hearing the comments from our elected city leadership. It’s frustrating because it feels that we are not heard.   It’s frustrating that instead of even LOOKING at the numbers involved in a NNR budget or even HALF the difference between the NNR and the proposed (almost max) rate, some on council vent their frustrations on the residents they have been elected to serve!  Not only that, but they throw the burden of the budget onto the citizens!  They are in that position and should be having the city manager direct his team to see what could be removed without significant impact to residents.  They should have given city management the direction to create a NNR budget from the get-go to at least have a starting point.  The burden of proving why they NEED  to take our money is on THE CITY - NOT the citizens.
 
    That all being said… I titled this blog “Keeping Hope…” and I meant it.  Please don’t give up reaching out to city leadership.  So many of us LOVE THIS CITY.  That’s why it’s heartbreaking to be treated this way by those who are called public servants. If we didn’t care, we wouldn’t even bother raising a fuss, but we do.  Please don’t stop caring or fighting for what you believe to be the right thing.  I think it’s fair to say that all of us want Waxahachie to be a better city for our children and grandchildren and generations beyond. The only way that can happen is to be involved. The more ideas that are given and shared amongst those in leadership positions, the better!  We just need to have a Council who is receptive to ideas.  
I don’t say that I have all the answers.  I don’t even pretend to, but I can say that I pray for our city leadership and citizens too.  The only true way to fail our city is to give up.  Please keep hope alive that our city leaders will become more receptive and open to the ideas of others.      
     
    We cannot continue to be a town that does things the same way over and over simply because “that’s the way it’s always been done.”  Sometimes you need to think outside of the box.  
 
    At the end of the day, we are all neighbors. This isn’t Dallas. It’s not Fort Worth. This is Waxahachie and we can all contribute to the current and future success of this city as long as we don’t lose hope.

4 - Public Comments:  While you are able talk about anything you'd like to during public comments, if you are going to speak regarding the budget or the tax rate, I'd highly encourage you to wait until that item since the sole purpose of this special meeting is to hold public hearings on each - the tax rate and budget for FY 23

5 - Public Hearing on the proposed Tax Rate for fiscal year 2022-2023
 
6 - Public Hearing on the Waxahachie proposed budget for FY 23 and there will be a vote on this item, but this vote is ONLY to set the date for the adoption, which they are proposing to be done at the next regular Council meeting, on September 6, 2022 at 7:00 PM.  They do provide a very, very thousand foot view of the budget in the packet, but if you are interested, I encourage you to look through it.

There is a worksheet for calculating all the different things like the No-New-Revenue Rate, the Voter-Approval Rate and Total Tax Rate.  It should be posted on this website at some point.  Ellis County already has theirs on there.  https://ellis.trueprodigy-taxtransparency.com/taxTransparency/propertySearch  At any rate, on that worksheet, you will notice lots of numbers, but two I want to highlight are the original Voter Approval Rate and the Final Voter Approval Rate.  To me, this goes to show the level of greed involved in this particular year's proposed tax rate and budget (since the budget is funded by the tax rate).  In their graph above, you will see a Voter Approval Rate of 0.63035. This is very important because if the City of Waxahachie proposed to adopt a tax rate ABOVE 0.63035, there would be a mandatory (by law) election held to get the voter's approval. This is where the next picture comes into play.

*** Hopefully you can read line 58 which shows the Voter Approval Rate of 0.626959.  The City COULD keep this amount, but they (and they have the right to do this, although I don't think they should have) added unused increments to * RAISE * the Voter Approval Rate higher!!  *** If the city had proposed a 63 cent rate at the original Voter Approval Rate, then the voters would have had a chance to approve or deny that tax hike... but now, we don't.

Unused Increment Rate

The unused increment rate is the three-year rolling sum of the difference between the adopted tax rate and the voter-approval tax rate and is only available to a taxing unit other than a special taxing unit. The unused increment rate can be used to increase the voter-approval tax rate, depending upon the tax rates adopted by the taxing unit in the previous three years. For example, a city has the ability to “bank” any unused amounts below the voter-approval tax rate to use for up to three years.

So while it is perfectly legal for the city to do this, I cannot believe our elected officials are okay with this.  It's not like the City was proposing anything even CLOSE to the NNR Rate of 0.540834, even though Ellis County is proposing to do that and they have tremendous growth as well.  Other cities are going BELOW the NNR Rate and our city won't even go halfway to it to help the taxpayers.
 
I have posted plenty of reasons why I don't think that the City Council should adopt the proposed 63 cent tax rate, but I think it can all boil down to this example I've shown above.  Yes, the city is growing, but use that growth and the massive amount of sales tax (which some is already going to fund the budget and lower the tax rate... let that sink in for a minute...) and give residents a break.  Yes, the Council might consider homestead exemptions NEXT YEAR, and that would be great for homeowners then and IF they do it, but they can also lower the tax rate RIGHT NOW.  In addition, the homestead exemptions won't help renters who keep seeing the taxes impact their rent and according to the city's website, that is almost 40% of residents.  The cost of rent in this town is RIDICULOUS.
