The Week of August 31st - September 4th, 2020 in the City of Waxahachie

Hello Friends!

There are only two meetings scheduled so far for this week, but you can check back on the City's calendar to see if any others are added.  http://www.waxahachie.com/calendar.php  The City Council Special Meeting is the MOST IMPORTANT meeting of the year, in my opinion.  It is your chance to speak directly to the City Council regarding the proposed tax rate for FY 21 and the proposed budget for FY 21.

6:00 PM - City Council SPECIAL MEETING

This is a very short agenda packet and I encourage everyone to read through it.  It holds a lot of important information regarding your taxes. 

- The current tax rate is and has been for years $0.68 per $100 of valuation.
- The proposed tax rate is $0.66 per $100 of valuation. Which is a decrease in the RATE, but still will increase the amount of taxes you pay to the City if your property valuation increased.
- The tax rate that would've given us the same revenue as last year and therefore not increase your City taxes is $0.6304 per $100 of valuation. (Called the NNR or No New Revenue rate.)
- The tax rate that would require an election and approval from the residents of Waxahachie is $0.6629 per $100 of valuation. You can see that the decreased rate also brings us just below this number so there does not have to be an election.

We were promised at LEAST a 2 cent reduction in the tax rate, back when the revenue cap was being calculated at 8%.  That was when the two cents came off the debt service; but, when the revenue cap was reduced to the 3.5% (as per SB 2), staff raised the debt service back up to nearly $0.17, losing that original two cent reduction and replacing it with a 2 cent reduction on the M&O side.  Therefore, I believe that our City can and should do no higher than a $0.64 tax rate, although adopting the No New Revenue rate of $0.6304 would be even better.  That's just where I stand on the issue; however, this meeting is not about what I think.  This meeting is about what you think and want and having the opportunity to voice it to Council.

Whether you are for/against/indifferent about the tax rate and proposed budget, this is your chance to tell your City Council exactly how you feel about it.  We will then be rendering a decision one week from this meeting.

One item of interest is under #6. Consider ordering an election to submit to all sworn police officers in the department a revised promotional system.

This meeting will not be live-streamed, but it is open to the public and as such residents are welcome to attend.

Public Hearing on the City of Waxahachie Proposed Tax Rate for FY 2021

The public hearing for the City of Waxahachie’s tax rate will be on Tuesday, September 1, 2020 at 6:00 PM.

Here is a direct quote from the notice published in the 08/23/20 edition of the Waxahachie Sun newspaper.  “The proposed tax rate is greater than the No-New-Revenue tax rate. This means the CITY OF WAXAHACHIE is proposing to increase property taxes for the 2020 tax year.” This public hearing is your opportunity to voice your approval or dissent for the proposed tax rate of $0.66 per $100 valuation. 

There was a roll call vote to approve this proposed rate, but I voted against it because it should be at $0.64, if not at the No-New-Revenue rate of $0.6304.  Anything above $0.6304 is an increase in taxes over last year.  The $0.66 rate IS a decrease of 2 cents from the past several years where the rate was at $0.68, so I was excited about the promise of lowering the rate somewhat; however, I don’t believe the City should raise taxes on its residents at all this year, even if that means an extra +/- $35 per year per homestead. There are many who can no longer afford this because it’s gone up EVERY year for the last several years. That has a compounding effect over the time. 

I do want to ensure the financial stability of the City, and that is happening with an increase in sales tax revenue and taxes from new properties that would allow for more revenue, even if they adopted the No-New-Revenue tax rate of $0.6304 per $100 valuation.

Due to the length of the 7:00 PM meeting agenda, this briefing session is being held a bit earlier than normal.  If there is any way that you can make it there, it is worth it.  The briefings are highly informational and I would really like for the City to stream Council briefings, even if they don't stream any other board briefings.

Items 5c, 6 & 27 are probably the most important items on this agenda.

5c - Set City Council meeting for September 8, 2020:  We have to set the date for our regular meeting from Monday, September 7th to Tuesday, September 8th due to the Labor Day holiday.

6 - Consider and tax action on an ordinance providing for the issuance of the City of Waxahachie, Texas Combination Tax and Revenue Certificates of Obligation, Series 2020, in an aggregate principal amount not to exceed $23,255,000; and ordaining other matters relating to the subject. I believe that bonds should be handled like the school district does and hold an election for them.  That being said, most of the monies are being used for infrastructure and street repair.  Here is a picture of the breakdown for your review.  If the picture doesn't come in clear enough, here is a link to view the document: https://drive.google.com/file/d/15KDTxn00khRqct7yMLS6IckLK14D4kaN/view?usp=sharing  I would be interested in your thoughts on whether you agree with these expenditures or not.  Here is the link to the Notice of Intention to Issue Certificates of Obligation on the City's website and it shows the principal amount of all outstanding debt obligations of the City is $160,210,000, among other data. http://www.waxahachie.com/Notice%20of%20Intent.pdf

27 - Consider setting Proposed Tax Rate and Dates for Public Hearing.  Staff has stressed that this is not the actual vote on the tax rate, but placing an item on a future Council agenda to vote on the tax rate.  Staff recommends taking a record vote to propose an ad valorem tax rate of $0.66000 for FY 2021 and schedule a public hearing for Tuesday, September 1, 2020 at 6:00 PM.  The City Council will consider adoption of the tax rate for FY 2021 on September 8th.

A couple notes about the tax rate.  $0.66 is a two cent decrease from the current rate of $0.68; however, the proposed rate exceeds the no-new-revenue rate (which some cities are adopting) of $0.63041, but does not exceed the voter-approval tax rate of 0.66289 (which we would have to have an election if we went over the voter-approval rate).  The tax rate was originally proposed of having an overall 2 cent reduction (from the debt service), but calculated using the 8% revenue cap.  Moving down to the 3.5% revenue cap gave us the ability to provide a 2 cent reduction from the M&O, but then staff changed the debt service back up by 2 cents.  This is why I would really like to see our tax rate no higher than $0.64.  That would still give the city more revenue than last year.  I understand that some won't agree with me on this, and that's okay.  I'm just stating how I came to this number.  The tax rate information is provided on pages 172 & 173 of the agenda packet, linked above.

11 & 12 - Public hearing on a request for a 7-11 at the Southwest corner of Brown St. and US Hwy 287 Bypass.  This location will be slightly larger than the above location, having 8 gas pumps (as opposed to 6 above), allowing for a maximum of 16 cars to fuel at any given time.

7:00 PM - Waxahachie City Council Regular Meeting

6-8: Is a public hearing regarding a new subdivision coming in called Dove Hollow.  There have been several residents interested in this development due to its proximity to the Arbor of Willow Grove subdivision.  The only change that I can see in this paperwork since the P&Z meeting, is that the developer has made all the lots fronting Grove Creek Road 80' in width.  Staff is recommending approval with a development agreement.

9-11: This is a public hearing regarding an apartment complex near the new high school called Mark on Conquest II. Staff is recommending approval with a development agreement.

12-14: This public hearing for a multi-family senior living facility called the Gala at Waxahachie has been continued to the 8/17/20 Council meeting.  There will be no discussion of it at tonight's meeting.

19: Consider proposed ordinance approving Amended Order of Election to be held November 3, 2020. This is necessary because Governor Abbott extended the voting for the 11/3 election so voters will now have from Tuesday, October 13th - Friday, October 30th for early voting.

20: Convene into Executive Session for deliberation regarding real property.  I have no idea what we will be discussing or if we will take any action on said item.
