The Week of October 25th - 29th, 2021 in the City of Waxahachie!

Hello Friends!
 
    There is a lot going on in Hachie right now, so let's get started!  First of all, this is the weekend of the Country Reporter Festival downtown. This year, with construction going on in and around the downtown area, the city has created interactive maps to help residents and visitors navigate to the festival easier. These maps include the best access points, a general festival map, and public parking areas. To view the maps and best routes, click the link below.
   
    Also, on Friday, October 29th at 9am please join us for a groundbreaking ceremony for the Wags-A-Hachie Dog Park! The dog park will undergo a complete renovation, adding new agility/play equipment, shaded picnic areas, new improved fencing, ADA sidewalk connections to the hike and bike trail, new trash receptacles, benches and picnic tables, concrete parking lot with lighting, and an art mural. FYI - the Wags-a-Hachie Dog Park will be closed starting Friday, October 22 and remain closed for renovations and improvements until approximately January 2022.  It should be really great for our furry residents once it has been completed!

**** 5:30 PM - Planning & Zoning Commission Work Session****

This work session is being held to discuss the proposed Wynne Jackson Industrial Complex, which comprises 575.97 acres near Settler's Glen subdivision. This is related to zoning case ZDC-155-2021.  You can see the proposed concept plan in the agenda packet link above, but I do not have any more information beyond that.  The work session will most likely be a presentation of this case and will be the first time that the P&Z Commission or I will have heard the details of the case.  The work session is a public meeting and you are welcome to attend, but there will not be any public comments taken at that time.  I do highly recommend those interested in this case to come hear the presentation, just please be aware that you will not have the opportunity to speak at this meeting.

The applicant for that case has also requested a continuance from the scheduled 10/26/21 P&Z meeting to be placed on the 11/09/21 P&Z meeting agenda.  That means that the commission does not plan to hear any testimony regarding the development at the Tuesday, 10/26 -  7:00 PM meeting.

I will keep you apprised of any changes that I know of and when this case is set to be on the P&Z agenda.

5g - This item is part of the consent agenda, which means if you'd like to speak about it, please do so during the public comments portion of the meeting right after the invocation and pledges are finished.  A resolution is being presented for adoption which would limit Public Comments to 5 minutes per person.  I really hesitate to adopt this policy, but I think that it is respectful to the residents and staff who are present at the meetings.  In addition, many governmental entities, such as the Ellis County Commissioner's Court, require signing up to speak ahead of the meeting and they only allow 3 minutes for public comments.  If this resolution is passed, it will still allow for folks to speak about any item, whether on the agenda or not, for 5 minutes, without having to fill out a form.  This time window seems to be very fair to both those who wish to speak and those citizens and staff present at the meeting.  Over time, there have been some who have used the public comments portion to speak at length: as much as 10 - 15 minutes or even more, and that seems excessive.  Most residents who have used the public comments portion of the meeting to address Council have only needed 2-3 minutes, so having a 5 minute window seemed to give folks enough time to express whatever concerns they may have.  Council are also accessible via email at any time, so that is always an option as well.

18 - 20: Public Hearing on a request by George Salvador for a Zoning Change located at 401 Ovilla Road.  This item passed P&Z by a vote of 6-0.  Staff also recommends approval.  Since Council last denied this item (back in May, I believe), they have reduced the density a tiny bit, made more of the larger lot sizes, and removed the alleys around the perimeter of the subdivision.  I am still undecided on this development; however, P&Z approved it with a vote of 6-0 and staff also recommends approval per comments.

I want to welcome all residents to the ground breaking ceremony for the new City Hall Annex on Wednesday, October 13, 2021 at 9:00 AM.  It will be located at 410 South Rogers St., across the street from City Hall.  This new building is a massive undertaking and will there to serve the citizens of Waxahachie for many, many years to come.  I hope to see you there!

There are several platting cases on the agenda for this evening, but there are two cases, in particular that I think many will be interested in.

27 & 28: Public hearing on a request by George Salvador for a zoning change from Single Family 1 (our largest single family lot sizes) to Planned Development - Single Family 3 (our smallest single family lot sizes) at 401 Ovilla Road.  This case came before P&Z a few times and our P&Z Commission did a great job working out details; however, when it came before the Council, we denied this case.  The density was too great and the overall benefits of this proposed development were not enough to overcome the density at that time.  They have since made some changes to the proposed development, including removing alleys throughout, but are still not even meeting all SF3 standards as set by the city.  That being said, staff is still recommending approval per comments.

29 & 30: Public hearing on a request by Josh Meredith, Van Trust Real Estate, for a Zoning Change from Planned Development - Commercial and Future Development to Planned Development - Light Industrial -1 to allow storage warehouse use, located just West of Interstate 35 and South of Butcher Road. (This is the location where Buc-ee's was going to be built.)  The applicant intends to create a Planned Development to allow for an industrial business park on 73 acres.  The proposed warehouse can be up to 1,215,200 sq. ft. in size.  Though this size warehouse will be capable of housing multiple tenants, there are currently no confirmed tenants at this time.

From the staff report: "While staff recognizes the appeal of the subject site for the purpose of a warehouse and realizes the significance of extending Butcher Road to the West, staff is concerned that the overwhelming presence a building of this size will have will disrupt efforts to make the I-35E gateway to the City more visually appealing.  City staff views the intersection of I-35E and Butcher Road as one of the most important intersections in the City. With only the warehouse use being proposed for this site, staff does not believe that this presents enough of an opportunity for the City to change the zoning..."  There are more details in the agenda packet, linked above.  Due to staff concerns, staff is recommending denial.  

Personally, driving I-35E, I see factories and industrial sites, so a brand new warehouse, that will bring with it many, many jobs, is not that bad of a deal for the city and its residents.  I do definitely agree with staff however, that the applicant can do better with the landscaping and screening that has been proposed, so I would like to see that change before approval.

The Week of October 4th - 8th, 2021 in the City of Waxahachie

Hello Friends!
 
I want to update you on some items that were discussed this past week.  First of all, thank you to everyone who reached out with your input on the various items Council took up in the work session on Thursday.  The minutes of that meeting are in the agenda packet for Monday's Council meeting, which I have posted below.  This summarizes some of what happened at that work session with many of the items folks have been interested in:
 
 1) City charter revisions: At this time, the Council is not supportive of having a charter change.  They do not want the mayor elected by the public.  You would have to contact members of council to see why they feel this way.  Here are all of our email addresses: https://www.waxahachie.com/government/city_council/index.php  There seems to be a fear that the voters will choose someone who is unqualified.  I believe in the voters and think that you would make the right call for our mayor.  Another point that was made was that the role of the mayor, in our current charter, is just about the same as any other councilmember.  While this is true, there are unspoken duties fulfilled by the mayor.  I do see the benefit of having a mayor appointed by council, because that person usually has quite a bit of experience, but it becomes all about politics.  I think people deserve to choose their mayor, but that won't happen any time soon.  I'm sorry about that.  
 
2) Discuss the policy for naming of City facilities: the consensus was to research, establish and adopt policy and procedures for naming City facilities, streets and/or parks.  Not sure exactly where everyone stands on building naming.  I believe that most did not have a problem with it as long as guidelines/procedures were established to guide those namings and we have public input on the matter when a naming opportunity arises.

3) Public Comment time limits will be set at 5 minutes. Many governmental entities have a 2 or 3 minute limit. A 5 minute limit should allow everyone to say what they need to say during public comments, but won't allow folks to monopolize the microphone.  As much as I really didn't want to put a limit in place, I do think that this is very fair and will be respectful of everyone's time at meetings. 

4) Golf Carts on streets - The police chief will draft up an ordinance on the matter for review at a later Council meeting.

5) Discuss Council initiatives
a) I brought forth the idea of having residents vote on the bonds that the city plans to issue in 2022.  It was decided that infrastructure items shouldn't be voted on by the residents, but that large non-infrastructure projects may need to go out for election.  For example, many of the items in the planned 2022 bonds are infrastructure items, except for about $2 Million for parks projects.  Some felt that the $2 Million was not worth the election expense or risk of voter fatigue to bring to residents for a vote.  All bonds, infrastructure or not, are backed by property taxes, so I think that having residents vote on the matter is the appropriate course of action. Again, you'd have to ask other council members their stance on the matter.

b) Council Member Smith asked if Council would support making a public statement in support of the Commissioner's Court proclamation in opposition to a federal vaccine mandate.  I supported Council Member Smith's idea of making the statement echoing the commissioners' proclamation, but other council members didn't agree that it was necessary; therefore, no action will be taken on the matter.

4 - Public Comments: Residents may address the City Council on any issue whether on the agenda or not.  Council is usually silent during this time, as we are limited by law on what we can say.  
 
6 - Proclamation proclaiming October 8, 2021 as Markert Strong Day in Waxahachie - named for a young man, Jackson Markert, who is currently receiving very aggressive chemotherapy treatment for osteosarcoma.
 
7 - Recognition of Waxahachie Police Department for meeting all standards in the Texas Police Chief Association Best Practices Program

8 - 17: Will all be continued to various dates.  See agenda packet for details.

20 - 21: Public hearing on request by Patty Dickerson for a Specific Use Permit (SUP) for clothing recycling bins located behind Central Presbyterian Church.  Staff is recommending approval per comments.

22 - 24: Continue public hearing by Brad Yates for Planned Development (PD) to allow a Private Club (Event Center) at 716 Dunaway Street.  Staff is recommending approval per comments.

25 - Consider proposed resolution for candidate nominations for the Ellis Appraisal District Board of Directors for the years 2022-2023.  Names that have been submitted for consideration thus far are Ryan Pitts and Logan Brady (by Council Member Travis Smith) and John Tabor (by Council Member Melissa Olson).  Other names may be brought up by Council for consideration at the briefing or meeting.

26 - Consider proposed resolution approving the City of Waxahachie Investment Policy as required by the Texas Public Funds Investment Act.  You can review the policy in the agenda packet link above.

27 - Consider proposed ordinance setting Water and Wastewater fees.  I will need more explanation of this in the briefing session.  The memo in the agenda packet says that "A review of fees in FY 2021 revealed that the Utilities Department is not collecting enough funds in specific areas to cover the cost of operations." From what I can tell, it does NOT look like they are looking to raise our normal water/wastewater fees, but that we will be changing rates for other services such as tapping, street cutting and road boring. I don't think that the average utility customer will be affected by these changes, but will ask for clarification at the briefing.

28 - Consider contract with Taft & Associates to provide a Crisis Response Specialist.  This position is one that Council added in to this year's budget and one that I am very excited about.  This position will help WPD provide better service in responding to people in mental crisis and provide an additional resource for first responders in need of support.

29 - 30: Convene into Executive Session to review performance evaluation for City Manager as permitted by Section 551.074 of the Texas Government Code and reconvene and take any necessary action.

5 - 12: Have all been continued to various dates.  Please refer to the agenda packet for specific dates per each case.

17 & 18:  Public hearing on a request by Patty Dickerson for a Specific Use Permit (SUP) for two clothing donation recycling bins located at 402 N College St.  These two bins are maintained by the Central Presbyterian Church and the proceeds from these bins go to support local community ministries such as the Little Pantry and various mobile libraries around the city.  Staff is recommending approval as presented.

19 & 20:  Continue public hearing on a request for a zoning change from PD-General Retail to PD-Multiple Family 2 zoning located at 809 Dr. Martin Luther King Jr. Blvd.  As previously stated at a prior P&Z meeting, the owners are trying to make an affordable development for residents.  It is a great looking development and I truly commend the effort to make it affordable, but safety is a priority. Staff is recommending denial due to a few reasons.  My primary concern, shared with staff, is the lack of an appropriate-sized secondary entry for fire services, should a fire break out in this development.  This concern was an issue during the first P&Z meeting and it has not been adequately resolved.  The Fire Marshal has also stated that due to this reason, he cannot support this project. His letter, along with other reasons staff are recommending denial can be seen in the agenda packet linked above.

Let me first state that I have no idea why it's being held in this location; HOWEVER, being a public meeting, you are welcome to attend.  

2 - Hear and discuss presentation of the Lake Parks Masterplan

** 3 - Discuss planning for and direction of City Charter revisions: Discuss process, format and timing of the Charter Review efforts (and Charter Review Committee) as well as hear from Council on preliminary areas to be reviewed.  One item that has been brought up in previous meetings is for the mayor of Waxahachie to be elected by the residents, rather than decided amongst the councilmembers.  While I see the merit of having the mayor chosen by the Council, I believe that this position should be elected directly from the citizens.  Any time a city's charter is being changed, it is a big deal and will be brought to the residents to approve at an election.

** 4 - Discuss policy for the naming of City facilities.  I really don't feel that city buildings should be named after people.  I understand that the new water plant has been named for past city manager Mr. Sokoll, but I just don't think this is a practice that should be continued, unless there is some set procedure/ parameters followed and resident input received.  Do you think city buildings should be named after people?  If so, what type of guidelines would you recommend following for such an occasion?  Is it okay for buildings to be named after persons who are still alive (a point which was brought up by a resident when this topic came up for discussion before)? Should there be a committee who reviews such decisions and if so, who should make up the committee? 

** 5 - Discuss limiting public comment times at City meetingsThis one is near and dear to my heart as I have been all about transparency and encouraging input from residents.  That being said, we have had a few residents who have used the public comments forum to discuss matters for 10 or 15+ minutes at a time.  When we have several people who wish to speak and a long agenda to get through, allowing for speakers to continue for that long is disrespectful of the time for those citizens in the chamber and the staff who are there to help with the meeting.  For this reason, I would support a public comment time limit of 5 minutes per person.  I think that 5 minutes is more than enough time for residents to convey what they need.  Many governmental entities have 2-3 minute time limits on their public comments.  There have been many times during public comments, where residents have had information to present to Council where 2-3 minutes would just be insufficient and that's why I would really like to see a time limit of 5 minutes, if we are to set one at all.

6 - Discuss security measures for City Hall

7 - Discuss policies for golf carts on public streets: Review laws currently in place, their limitations/confusions and other alternatives to consider.  At this time, I don't see a problem with implementing this in accordance with state law.

8 - Discuss options for spending of COVID Relief Funds.  Review staff proposed uses (which will be announced at the meeting) along with fund limitations for use and timelines.

** 9 - Discuss City Council initiatives - The only one I know of at this time is my proposal to have city bonds in 2022 voted on by the residents. There are costs involved with elections, however, city bonds are backed by property taxes, so it seems only appropriate for the city to hold an election to allow voters to approve/deny bond debt.  The city has issued millions of dollars in bond debt without elections since 2000.  I don't know how many bonds were taken to voters prior to 2000.  Some say that the Council is elected and therefore should make the decisions, which is true, but I do think that residents should have a say in this matter, just like the school district does with their debt.  I can't go take out a loan using your home as collateral, so why should the city be able to do that without your input?

** This is a really jam-packed agenda with a bunch of important topics to be discussed and considered.  There are no public comments for this work session and each item is listed as "Discuss" or "Hear" instead of "Public Hearing" in which residents can provide input - hence why I'm asking for input beforehand.  I believe Council will be providing direction to staff on all of the above issues, so this is a very important meeting to attend, if you're able.  Also, given the location of the work session, I don't believe it will be live-streamed. **

The Week of September 20th - 24th, 2021 in the City of Waxahachie

Before we jump into this week's meetings, one item to note: Governor Abbott has set a date for the Special Runoff Election in House District 10 between Wray and Harrison.  Early voting will be this week at the Elections office (204 E. 15 - 17: This P&Z case, ZDC-131-2021, is a public hearing on a request by Brad Yates, Colonial Restoration Group, for a PD to allow an event center within a Single Family 3 Zoning District located at 716 Dunaway St.  This is worth mentioning because it is a bit irregular to allow such a use in a neighborhood, but staff is recommending approval per staff comments. It would definitely be great to have this building refurbished and able to be used again.  I personally have some of the same concerns as staff, with regards to noise that may result from being an event center with an outdoor courtyard.

21 - Consider proposed Resolution for Candidate Nominations for the Ellis Appraisal District Board of Directors for the Years 2022-2023.  The way this works should definitely be changed by the legislature, but as of now, taxing entities are charged with selecting the Board of Directors for the appraisal district.  Each entity receives a certain number of votes - I believe based on their total taxable value, but I could be off on that.  
 
This Board of six directors governs the Appraisal District. Board members select and hire the Chief Appraiser, adopt the annual District budget, appoint the Appraisal Review Board, appoint a Property Owner Liaison Officer, and ensure the District follows policies and procedures required by law. The Board of Directors does not appraise property or make decisions affecting the appraisal records. 
 
I currently do not have any nominees for this position, nor am I aware of any nominees from the rest of Council.  That being said, candidates will most likely be nominated at the briefing or meeting for the position by various members of Council, but it is totally possible that there will be no nominations either.  We will just have to wait until the briefing and meeting on Monday to see.

Special - Analysis on Waxahachie's Tax Rate

I received an email from a retired city finance director who is light years ahead of me when it comes to numbers and analysis.  He took it upon himself to run some numbers regarding Waxahachie's tax rate, which the city likes to point out is the lowest in Ellis County.  Some have used this as justification for not lowering taxes further, but simply comparing tax rates without looking at any other data really isn't a fair assessment of the tax burden faced by the citizens.
