6:00 PM - City Council Briefing Session

This briefing session is being held to discuss items for the 7:00 PM regular Council meeting.  These briefings are filled with tons of information and where Council often times does the bulk of the discussion on items.  You are welcome to attend these briefings, but unfortunately, they are not live-streamed at this time.

There are just a couple of items I'd like to point out.
 
8-11: These public hearings are regarding two clothing donations boxes.  One located at 1713 W. Hwy 287 Business and one at 2100 Brown St.  There is a case for each box to be considered separately.  At the P&Z meeting, they recommended 6-0 for denial of the SUP that would allow these bins to continue operating. The commission is charged with looking at the zoning only, whereas the Council can take other factors into account.  These two boxes are a for-profit operation and supply a third party supplier with the clothing that is donated.  They can't say for sure what happens to the clothing once it has been turned over to the third party.  I understand that these can be unsightly, but Council has the capability to add restrictions to the SUP in order to help that and if those guidelines aren't followed, then the SUP (specific use permit) can be revoked and the bins would have to be removed.  Because these do serve the community in a helpful way to donate clothing as well as them being on private property, I tend to believe they should be allowed to continue with specific guidelines. What are your thoughts?  Do you ever use them?  Do you think they should be allowed?  Do you think they're just eyesores and need to go?  I'd love your input on the issue.

20: Consider setting proposed tax rate and dates for public hearing.  This isn't when we actually adopt the tax rate.  That will likely be done at the 9/7/21 Council meeting.  This item has us set the public hearing, which will most likely be at 6PM on 08/31/21.  It's at that time, you can come speak for or against the proposed tax rate which is planned to be $0.66 per $100 of valuation.  This is the same rate that it was last year when we lowered it from $0.68. The no-new-revenue rate for this year is $0.62588, so I have a tremendous amount of heartburn approving a $0.66 rate.  Why do I say all this?  So that you have the facts of what's happening and what's running through my mind.  I don't enter into this lightly in any way and am struggling with it and will continue to struggle with it until it's done.  I know that people are being taxed too much and wish I could do more to help with that.  I'll announce it again when the dates are set in stone, to make sure you know when the public hearing and adoption will be so that if you'd like to come out and address Council on the issue, that you have the chance to do so.  As always, I appreciate your feedback on this matter and any others that you wish to connect with me about.

21: Consider authorizing an initial guaranteed maximum price (IGMP) for construction activities associated with the City Hall Annex project in the amount of $14,500,000.  $7.5 million of that total was recently approved in the FY 20-21 bond package and another $7 million is included in the FY 21-22 operation and maintenance budget.  There will also be another $1.5 million in additional costs associated with the annex, not related to the actual construction of the facility or included in the figures above.  These additional costs will consist of furniture, fixtures, equipment, technology and moving-related expenses.  Staff anticipates appearing before Council early in FY 2021-2022 to request an additional authorization associated with these expenditures.  This is an awful lot of money, but it's important that you know where your money is going and this building will serve the community for many, many years to come.

This is a pretty standard meeting, but I just want to quickly mention 9&10 and 11&12.  These two cases are regarding clothing donation boxes at two locations (on private property, it appears) and staff is saying that the owner must have an SUP (specific use permit) for these even though they are on private property and are recommending denial of the SUPs.  While I understand that these can be an eyesore when the clothes are left outside the donation boxes, I think that they provide a useful service to the residents and are able to help others by recycling the clothing.  Not only that, it appears, in my opinion, to be overreach if these are indeed located on private property.  What are your thoughts on the situation?

This whole work session is being held as our 2nd, and most likely final budget work session for the 2021-2022 budget.  There are no public comments at this work session, but it is still a great thing to come and sit in on. It will provide updated sales tax revenue projects, reflect changes in property valuations, and updated costs of a few of the previously discussed initiatives.
 
This work session is open to the public and I highly encourage folks to attend if they can.  There will be public hearings still to come, however, before the budget is approved.  I just don't have dates on those as of yet.  This work session will not be live-streamed.

This is a fairly short, routine meeting, except for one item, which I'll mention.

 14. Consider and take action on an ordinance providing for the issuance of the City of Waxahachie, Texas Combination Tax and Revenue Certificates of Obligation, Series 2021, in an aggregate principal amount not to exceed $43,300,00; and ordaining other matters relating to the subject.  This is something that is not taken lightly.  I would prefer that we have General Obligation bonds so that the public can vote on these matters, but until that happens, this is what we have to consider at Monday's meeting.  I'm attaching a list of all the projects paid for with these bonds for transparency and so that you can see what is planned for those funds.  Paying for these bonds is currently included in our $0.66 tax rate, which was lowered last year from $0.68.

The Week of July 26th - 30th, 2021 in the City of Waxahachie

    I hope y'all are doing well and staying cool.  It looks to be a hot week ahead.  As far as city business is concerned, we have a pretty slow week, but that should pick up the first week in August.  Please check back on the city's calendar to see if any new meetings are added, but so far we only have the P&Z briefing and meeting on schedule for this week.  The city's calendar can be found here: https://www.waxahachie.com/calendar.php
    One item to note is that we have the election day for the CD6 race on Tuesday.  So far, only 5.07% of registered voters in Ellis County have participated in the early voting for that runoff race.  The two candidates are Susan Wright and Jake Ellzey (listed here in the order that they are found on the ballot). Polls will be open from 7a-7p on Tuesday and voting locations can be found here: http://www.co.ellis.tx.us/DocumentCenter/View/14489/Election-Day-Locations-July2021?bidId= Please note that the Elections Office is NOT one of the polling places on Tuesday.  Please be sure to have your voice heard!

All this means is that one or more members of the Waxahachie City Council may be present for a walking tour of the City water plants, beginning at the wastewater treatment plant at 8:30 AM.  This is not an official meeting and no action will be taken. It is simply a tour of the plants.

7:00 PM - City Council Regular Meeting

This is really a fairly standard meeting.  Some of the P&Z items have been continued and when that happens, we don't get any information on that case other than we open the public hearing and move to continue it to whatever date is requested.  Pretty standard. A couple items you may find interesting are:

22 - Consider award of bid for construction manager at risk for Fire Station #4

23 - Consider award of bid for Lee Penn Park swimming pool construction contract and awarding a supplemental appropriation and use of park dedication fee funds.

** 25 - Discuss potential charter amendment - I requested this to be on our agenda to see if the will of Council is to have the mayor elected outright by citizens, as opposed to our current method of selecting the mayor among the council members.  Due to open meetings laws, Council members are not allowed to talk about city issues amongst themselves outside of an open meeting, so when we want to discuss an issue, it usually needs to be on the meeting agenda or have a workshop on the issue.  When an item is listed as "discuss", we do just that, but may give staff some guidance on which direction to go in regards to a particular item.  There is usually no formal action taken unless specified on the agenda that there will be action taken.
